Mesler Performance Group ("Mesler," "we," "us," or "our") operates the Exec Capacity mobile application, the stevemesler.net website, and related services (collectively, the "Service"). This Privacy Policy explains what information we collect, how we use it, and the rights you have over that information.

By using the Service, you agree to the collection and use of information in accordance with this policy. If you do not agree, please do not use the Service.

1. Who We Are

Mesler Performance Group is a performance coaching company based in Calgary, Alberta, Canada, founded by Steve Mesler. The Service includes the stevemesler.net website and the Exec Capacity mobile application, which is delivered through a white-labelled application built on the Everfit platform. 2. Information We Collect

Information you provide directly:

• Account information: name, email address, password, and profile details you choose to share.

• Onboarding responses: goals, preferences, and intentions you enter during setup, including responses to our Big Five goal framework.

• Program data: workout logs, habit check-ins, reflection entries, weekly audit responses, and notes you create within the Service.

• Communications: messages you send to us, your coach, or through in-app chat.

Health and fitness data:

With your explicit consent, the Service may collect health and fitness information such as workout activity, exercise logs, heart rate, sleep data, steps, and other fitness metrics. You control whether this data is shared and can revoke access at any time through your device settings.

Information collected automatically:

• Device and usage data: device type, operating system, app version, crash logs, and basic interaction data used to keep the Service running.

• Cookies and similar technologies: used only where necessary to authenticate sessions and maintain core functionality.

Information from third-party integrations:

If you choose to connect third-party services (such as Apple Health, Oura, Garmin, Fitbit, Google Calendar, or Outlook), we receive data from those services as permitted by your authorizations. You can disconnect these integrations at any time.

Health Data Utilization

Our app collects and processes health-related information such as workout activity, exercise logs, heart rate, and other fitness metrics. This data is collected only with your explicit consent and is used exclusively to deliver core app features, including fitness tracking, progress insights, and cross-device synchronization.

We do not share your health data with any third parties, and we do not use this data for advertising or marketing purposes. All health information is stored securely and access is limited to authorized personnel only. We adhere to industry best practices to ensure data protection.

If you choose to delete your account, all associated personal and health-related data will be permanently deleted from our systems.

3. How We Use Your Information

We use the information we collect to:

• Deliver the Service, including personalized programs, habit tracking, and goal reviews.

• Provide coaching, feedback, and support from your coach.

• Sync your data across your devices and integrated services.

• Communicate with you about your account, program updates, and important notices.

• Maintain the security and integrity of the Service.

• Comply with legal obligations.

We do not sell your personal information. We do not use your health data for advertising or marketing purposes.

4. How We Share Information

We share information only in the following limited circumstances:

• With your coach: the Mesler coach assigned to your program can see your program data in order to deliver coaching.

• With service providers: we work with trusted vendors who provide infrastructure for the Service, including Everfit (our platform provider), Wix (our website host), and cloud hosting providers. These providers are contractually required to protect your information and may only use it to provide the services we have engaged them for.

• For legal reasons: we may disclose information if required by law, regulation, legal process, or enforceable governmental request.

• In the event of a business transaction: if Mesler is involved in a merger, acquisition, or sale of assets, your information may be transferred, subject to the terms of this policy.

 

5. Data Retention

We retain your information for as long as your account is active and for a reasonable period afterward in case you wish to reactivate the Service. Certain records may be retained longer where required by law or for legitimate business purposes such as financial record-keeping. When retention is no longer necessary, we delete or anonymize the information.

6. Your Rights

Depending on your jurisdiction, you may have rights to access, correct, delete, or export your personal information, and to object to or restrict certain processing. To exercise any of these rights, contact us at steve@meslerpg.com.

Account Deletion

To request the deletion of your personal information from our database, you can submit a request through our in-app settings or contact form available on our platform. For such requests, please write "delete my account" in the subject line, and include your first and last name and e-mail address in the body of the message. We will use commercially reasonable efforts to honor your request. We may retain an archived copy of your records as required by law or for administrative purposes. Please note that we will store communications you may send through the Service, as well as any comments you may post, and they may not be subject to modification or deletion. You may also control the information that we collect through the settings in your browser or mobile device. You may configure your browser to reject cookies from our app and may adjust the settings of your mobile device to prevent the Platform from obtaining location information. However, please note that the Service may rely on cookies and location information to function properly and some parts of the Service may not be available if you disable cookies.

 

7. Security

We use commercially reasonable administrative, technical, and physical safeguards to protect your information. No method of transmission or storage is completely secure, but we work to protect your data using industry best practices including encryption in transit, access controls, and limiting access to authorized personnel.

 

8. Children's Privacy

The Service is intended for adult executives and is not directed to children under 18. We do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact us so we can remove it.

 

9. International Users

Mesler is based in Canada. If you access the Service from outside Canada, your information may be transferred to, stored, and processed in Canada or other countries where we or our service providers operate. By using the Service, you consent to such transfers.

 

10. Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will revise the "Last Updated" date at the top of this page and, where appropriate, provide additional notice through the Service. Your continued use of the Service after changes become effective constitutes acceptance of the updated policy.
